TAKE BACK THE COURT: S.B. 8 RULING DEMONSTRATES COURT’S CONTEMPT FOR ABORTION RIGHTS
“The Court isn’t wasting time, and neither should we,” says Lipton-Lubet
SAN FRANCISCO, CA (December 10, 2021) — Today, the Supreme Court issued a ruling in Whole Woman's Health v. Jackson, the abortion providers’ lawsuit challenging Texas’ unconstitutional 6-week abortion ban. Take Back the Court Executive Director Sarah Lipton-Lubet released the following statement:
“Today's ruling once again demonstrates the Supreme Court's contempt for Texans in need of abortion care and the millions of women across the country who know their rights are next on the chopping block. While the Court allowed the abortion providers' litigation to proceed — the only just result — it still refuses to block SB8, continuing to deny Texans the access to abortion they so desperately need. As Justice Sotomayor wrote: ‘The Court should have put an end to this madness months ago, before S.B. 8 first went into effect. It failed to do so then, and it fails again today.
“The stolen, right-wing Supreme Court majority is an existential threat to Americans’ reproductive freedom. The Court has passed up repeated opportunities to block this blatantly unconstitutional law. Instead, the right-wing majority continues to inflict irreparable harm on thousands of pregnant Texans — as it has been now for more than 100 days. And, at the very same time, the justices are contemplating Dobbs v. Jackson Women’s Health Organization, which could end Roe as we know it.
“The Court isn’t wasting time, and neither should we. We must restore judicial balance and shield Americans’ rights and our Constitution from further assault. The only way to do that is to expand the Court.”
Take Back the Court raises awareness about the urgent need to expand the number of seats on the Supreme Court to address the theft of the court by Senator Mitch McConnell during the Obama Administration. Without adding seats, Congress will not be able to restore the right to vote, ensure reproductive freedom, protect workers, halt our climate emergency, or pass new legislation. Court expansion, which can be accomplished without a constitutional amendment, is the only reform that enables the un-rigging of the system and the restoration of democracy.
