Statement on Today’s DACA Ruling

Take Back the Court Director Aaron Belkin released the following statement today: 

“Today’s decision provides important relief for hundreds of thousands of Dreamers, but we cannot let it blind us to the danger of this Court. It’s clear from Chief Justice Roberts’s opinion that we were only saved by the Trump Administration’s incompetence. Roberts made it clear this Court does not question whether Trump can rescind DACA — only how his administration went about it. 

“Trump can — and will — try again. Roberts’s opinion makes clear that if the Administration did an even slightly better job providing legal cover for its obvious discrimination, the Court would have ruled in Trump's favor. And the Chief Justice essentially drew Trump a roadmap for how to do it next time. 

“Meanwhile, Brett Kavanagh and the other conservative Supreme Court justices didn’t even bother attempting to join Roberts in putting on a temporary show of moderation. They continue to show their true colors at every turn, injuring people of color at every opportunity.

“Today’s narrow escape is a call to action. We must fight back. We must unpack the Court before this conservative bloc gets another opportunity to pursue its real policy of wreaking havoc on our country’s Dreamers.”
